Terms and conditions for nurtureuk training courses

As a registered charity, nurtureuk relies on contributions and service payments to support its mission of achieving an inclusive education for all. By completing a booking form for training from nurtureuk, you are agreeing to these terms and conditions, unless otherwise agreed with you in advance in writing by a nurtureuk representative.

Who we are

We are nurtureuk, a registered charity (England and Wales charity number 1115972, Scottish registered charity number SC042703), and a private company limited by guarantee (number 05562426).

Our services

We will provide training services with reasonable skill and care, in line with good professional practice, and in line with the description of the product or service available on our website. We reserve the right to change the product/service description in line with our commitment to continuous improvement of our products and services.

Please note that the language of all sessions, along with all supporting materials is English. Any course assignments and applications for awards must be provided in English, and assessments for our award schemes will also be carried out in English.

It is the responsibility of course participants or schools assessment to present evidence that meets the assessment requirements in English.

Your obligations when you book training

You will provide us with the information required to ensure training resources and access links are delivered to the correct addresses (postal & email). We will not be liable for any delays caused by issues outside of our control. 

Keeping everyone safe during coronavirus (COVID-19)

Nurtureuk is committed to keeping everyone safe during the continuing pandemic. We are prioritising online delivery for most of our services. For services that are booked as face-to-face delivery, or where face-to-face delivery is an option, we will follow the government guidelines in place at the time of delivery, our own guidelines for consultants and trainers, and our risk assessment for running training and consultancy safely. We will share our guidelines and risk assessments with venues and clients as appropriate to ensure that we can run the session safely. 

If a session has to be cancelled due to central or local government restrictions or guidance in force, we will transfer the session to another date, or provide a replacement online session within a reasonable time frame. We will not be liable for any costs incurred by you due to the cancellation. 

If a session has to be cancelled because a venue does not follow our guidelines or meet its obligations under our risk assessment, we will transfer the session for another date or provide a replacement online session within a reasonable time frame. We will not be liable for any costs incurred by you due to the cancellation.

If a session has to be cancelled because you do not follow our guidelines or meet your obligations under our risk assessment, we will treat this as a cancellation by you (see ‘Cancelling a booking’). 

If a session has to be cancelled by us because of a reason related to COVID-19 (for example, illness of a consultant or trainer or a member of our team having to self-isolate, we will treat this as a cancellation by us (see ‘Cancellations by nurtureuk’). 

Virtual attendance

If you commit to attend a session virtually, you are agreeing to the following:-

  • that online delivery will be conducted via Zoom* (or by another platform by prior written agreement with us). 

  • It is the delegate's responsibility to ensure that the email address provided for the online training is correct and that the link has been received no later than 24 hours prior to commencement. If you do not receive your email invitation, please contact bookings@nurtureuk.org at least 24 hours prior to the start of the course. Note - please ensure you have checked your spam/junk folder for any emails (as occasionally they go into this folder)

  • that you will be in a location where you are able to access Zoom (or the alternative platform we have agreed to use), and that your device setup, internet connection and your own or your workplace’s security settings will not interfere with your active participation in the session. 

  • that, unless otherwise agreed with us in writing in advance of the session you will be participating individually (with one person using your device, and with one device being used by each participant, so our trainer or consultant can see everyone involved), in a quiet space, where you are unlikely to be disturbed. 

  • that you will participate in the session, respecting the ground rules for the session, and respecting the other participants in the session 

We reserve the right to end your participation in a booked session if we are unable to complete it because of a failure on your part to follow these terms, or if a failure on our part to follow these terms is affecting the experience of other participants negatively. In these cases, we will treat this as a  cancellation by you (see ‘Cancelling a booking’).

Data protection and confidentiality

As part of the agreement with us, you may need to share personal data and confidential information with us. Any personal data you share with us will be stored and processed in line with our responsibilities under the GDPR and our data protection policy, which is available from dataprotectionofficer@nurtureuk.org, and any data processed by others on our behalf will be processed in line with a processing agreement that gives equivalent protection. We will treat confidential information in strict confidence, except in cases where we have a legal responsibility to disclose it. It is your responsibility to decide whether personal data you control and other confidential information is appropriate to share with us.

Safeguarding

Every child has the right to be free from abuse and neglect and to be treated with dignity and respect. Nurtureuk is committed to safeguarding the welfare of children and requires all staff and freelance consultants to share this commitment. We recognise our responsibility to ensure that all our actions protect the safety and welfare and promote the well-being of children, and the staff and freelance consultants who work for us. Intellectual property

As part of the training agreement, we may share with you publications, templates, tools and other resources that are the intellectual property of nurtureuk or of third parties. These must only be used for your non-commercial purposes, and should not be reproduced or shared with any other parties.  You may not remove any copyright or other proprietary notices within resources shared with you.

Cancelling a booking

1. If you cancel an event less than 60 days prior to the event, we reserve the right to charge late cancellation fees.

2. Cancellations of bookings should be sent to bookings@nurtureuk.org

3. If you notify us of your cancellation prior to 5.00PM, 60 days before the event, nurtureuk will provide a full refund less 10% administration fee of the price including VAT.

4. If you notify us of your cancellation 5.00PM, 59 days prior to the event, nurtureuk will provide a 50% refund of the price including VAT.

5. If you notify us of your cancellation after 5.00PM, 30 days prior to the event, no refund will be provided.

6. If you cancel a course it is extremely important that any outstanding payment is settled in full as soon as possible, as failure to do so could prevent you or your school from being able to attend future events, or ordering publications, and further action may be taken. If you have any queries, please call the nurtureuk's head office to speak to someone in our accounts department.

7. If payment is not made, you or your school may become ineligible to book onto further courses until payment is made, and failure to comply with the cancellation policy could result in further action being taken.

8. nurtureuk reserves the right to cancel any event up to 14 days prior to the event date. nurtureuk will not be liable to cover or compensate for attendees' expenses should an event be cancelled. 

Transferring a booking

1. At any point, up to and including the day of training, you can change the attendee name.  In this case it is your responsibility to ensure that course resources are passed to the new delegate. We will not send additional course material.

2. Transfer to another course may be possible, with sufficient notice and availability, at the discretion of nurtureuk, and would incur a transfer fee of £50 plus VAT per place.

Failure to attend

In the event a delegate fails to attend the event, the training fee is non-refundable. Nurtureuk will not accept any transfer or refund request for the cost of the event. If the invoice has not yet been paid, it is still due to be paid as per our terms and conditions. 

Exceptional Circumstances

Exceptional circumstances will be considered at nurtureuk's sole discretion and may result in a credit note, not a refund.  

Cancellations by nurtureuk

In rare cases, we may be forced to cancel a course at short notice. If this happens, we are not liable for any costs incurred by you and we will endeavour to reschedule as soon as possible. If we cancel when payment has already been received, we will offer you a rescheduled date. If we cannot agree this with you within 30 days, we will contact you to arrange an appropriate refund within 7 days.

Payment terms

Payment is due within 21 days of receipt of invoice. We aim to invoice within 7 day of the date that the booking was made.  

We reserve the right to cancel a booking if we have invoiced in advance and not received payment in line with our terms of payment by the date of the booking.  We will escalate if we have not received payment within 30 days of the invoice being issued.
